Welcome to kiabi.ge
(the “kiabi.ge”). Please review the below Terms and Conditions that
govern your visit to our Site and your use and purchase of products
(“Services”) from our Site before you place an order on Kiabi. We recommend you
visit this section from time to time as Kiabi may modify, alter or
update these Terms and Conditions and Policies. Any changes made to these Terms
and Conditions and/or Policies after you have placed an order on our Site will
not affect that order unless Kiabi is required to make the change by
law.

 

Acceptance of Terms and Conditions

These Terms and Conditions apply as between you, the User of this
Site and Kiabi, the owner(s) of this Site. Your agreement to comply with
and be bound by these Terms and Conditions occurs upon your first use of our
Site. If you do not agree to be bound by these Terms and Conditions, you should
stop using our Site immediately.

 

Age Restrictions

Persons under the age of 18 should use this Site only with the
supervision of an Adult. Payment Information must be provided by or with the permission
of an Adult. However, Kiabi reserves the right to only accept orders
from those over 18.

 

Intellectual Property

All Content included on the Site including, but not limited to,
text, graphics, logos, icons, images, sound clips, video clips, data
compilations, page layout, underlying code and software is the property
of Kiabi.

Your use of the Site and its contents grants you no right to
reproduce, copy, distribute, store or in any other fashion re-use material from
the Site unless otherwise indicated on the Site or unless given express written
permission to do so by Kiabi or the relevant supplier or
manufacturer.

 

Feedback, Comments and User Submissions

Kiabi welcomes your feedback and comments regarding our Site,
products and Services. We do not accept confidential or proprietary
information. All comments, feedback, ideas, suggestions, and reviews
(“Submissions”) shared with Kiabi are not confidential and will
become the sole and exclusive property Kiabi. You may not post any comments
or reviews that contain obscene language or pretend to be someone other than
yourself or use false email addresses. Kiabi reserves the right to
remove or edit any submissions.

This Site may contain links to other sites. Unless expressly
stated, these sites are not under the control of Kiabi or that of our
affiliates. We assume no responsibility for the content of such websites and
disclaim liability for any and all forms of loss or damage arising out of the

Use of Communications Facilities

When using the Contact form or any other online communications
infrastructure, including but not limited to, web-based email, message boards,
live chat facilities and email links (“System”) on the Site now or in the
future you should do so in accordance with the following rules:

Accounts

In order to procure some of the Services and facilities on this
Site you will need to create an Account, which will contain certain personal
details and Payment Information that may vary based upon your use of the Site
as we may not require payment information until you wish to make a purchase. By
continuing to use this Site you represent and warrant that:

Your creation of an Account is further affirmation of your
representation and warranty.

It is recommended that you do not share your Account details,
particularly your username and password. Kiabi accepts no liability
for any losses or damages incurred as a result of your Account details being
shared by you. If you use a shared computer, it is recommended that you do not
save your Account details in your Internet browser.

If you have reason to believe that your Account details have been
obtained by another without consent, you should
contact Kiabi immediately to suspend your Account and cancel any
unauthorized orders or payments that may be pending.

Please be aware that orders or
payments can only be cancelled up until provision of Services has commenced. In
the event that an unauthorized provision commences prior to your notifying us
of the unauthorized nature of the order or payment, Kiabi accepts no
liability or responsibility and you should make contact with the third party
service provider detailed in the Purchase Information.

 

Orders, Pricing and Merchandise Availability

Merchandise availability on Kiabi is not guaranteed, as
stocks may be low. All orders are subject to acceptance and availability and in
some cases orders cannot be processed. Kiabi reserves the right to
refuse or cancel any order for any given reason at the time. When making an
order on Kiabi you will receive an email with your order details
confirming that we have received your order and that it is being processed.

All pricing information on the Website is correct at the time of
going online. Kiabi reserves the right to change prices and alter or
remove any special offers from time to time and as necessary.

In the event that prices are changed during the period between an
order being placed and Kiabi processing that order and taking
payment, provision of Services shall commence as per your order and you will be
charged the original price.

Kiabi attempts to be as accurate as possible in the
description of the products. However we do not warrant that such a description
is totally accurate, complete, reliable and error free. In case you are not
satisfied with the product ordered by you, you can return it to us according to
the relevant provisions of our Returns Policy.

 

Payment

Upon receiving your order, Kiabi will send you an email
confirming that we have received your order and that it is being processed. A
validation check and authorization by the card issuer will be made and payment
will be debited and cleared from your account at the time an order is
made. 

We accept Visa, Mastercard, Cash
on delivery and Tabby. You can also chose to pay cash upon delivery. If you
elect to pay cash on delivery and do not pay for your order on delivery this
will be a deemed rejection of the goods and title in the goods shall vest in
us. In the event that your order is processed in the United Kingdom you may
need to pay import tax to receive your goods. Kiabi will collect any
import tax and duty due when taking payment for your order from you as agent
for you and will pay these sums to the relevant authorities on your behalf.

Kiabi takes care to ensure that the Site is secure and that
details of your order and payment are kept confidential, but in the absence of
negligence on our part we cannot be held liable for any loss you may suffer if
a third party procures unauthorized access to any data you provide when
accessing or ordering from the Site.

Please note that we do not store credit card details nor do we
share customer details with any third parties.

information will NOT be stored, sold, shared, rented or leased to any third
parties.

- Georgia is our country of
domicile

-Website  will
NOT deal or provide any services or products to any of OFAC (Office of Foreign
Assets Control) sanctions countries in accordance with the law of Georgia

- We accept payments online using
Visa and MasterCard credit/debit card in SAR. 

- Refunds will be done only
through the Original Mode of Payment.

- Any dispute or
claim arising out of or in connection with this website shall be governed and
construed in accordance with the laws of Georgia. 

Returns

Returns are free on Kiabi.
You may return an item within14 days after receiving it. You will be refunded
the full value of your purchase minus the shipping costs. Customs duties,
clearance and handling fees are non refundable as they are paid to third
parties. Please refer to our Returns Policy for details.

  

Store Credit

We do not provide any cash
refunds, if you wish to return an item, the price paid for your items will be
returned to you via Kiabi store credit or as a credit card
refund (if you paid for your items using a credit card). You can then use this
credit to purchase a new size, colour or a totally different item altogether. This store credit is
valid for one year from the date of return.

Store credit can not be exchanged
for cash or transferred to any person's bank account. This is for the sole
purpose of use on www.kiabi.sa

 

 

 

Insurance and Delivery

All orders made on Kiabi are insured from the time of
dispatch until they are delivered to your specified delivery address. We require a signature for all orders
delivered at which point the goods are no longer the responsibility
of Kiabi and that responsibility passes on to you.

Please note that Kiabi aims to deliver all orders within
1-5 working days (this
may take a bit longer during sale periods) unless otherwise stated on the Site.
Estimated delivery times are to be used as a guide only. We are not responsible
for any delays caused by the local customs clearance processes.

 

Kiabi Premier Conditions of use

The service is for personal use only and is not available for
customers who purchase goods for business, re-sale, or wholesale purposes. It
is your responsibility to ensure you use the service in accordance with
the terms and conditions. Any breach by you will result in the termination of
your subscription and no refund will be given. Kiabi reserves the
right to amend these terms and conditions and/or discontinue the offer at
any time. Kiabi discontinues the offer, you will be refunded
pro-rata for the remaining months of your subscription.

Termination and Cancellation

Either Kiabi or you may terminate your Account.
If Kiabi terminates your Account, you will be notified by email and
an explanation for the termination will be provided.  Notwithstanding the
foregoing, we reserve the right
to terminate without giving reasons.

If Kiabi terminates your Account, any current or pending
orders or payments on your Account will be cancelled and provision of Services
will not commence.

Kiabi reserves the right to cancel orders or payments without
stating reasons, for any reason prior to processing payment or commencing
Services provision.

If orders or payments are cancelled or you terminate your Account
for any reason prior to commencement of Services provision you will be refunded
any monies paid in relation to those purchases.

 

Provision of Services

Provision of Services shall commence when full payment has been
received.

Kiabi shall use its best endeavors to provide the Services
with reasonable skill and care.

Provision of all Services shall be subject to the terms and
conditions pertaining directly to those Services.

In the event that Services are provided that are not in conformity
with your order and thus incorrect, you should contact us within 7 calendar
days to inform us of the mistake. Kiabi will ensure that any
necessary corrections to the Services provided are made within 7 working days.

 

Privacy

Use of the Site is also governed by our Privacy Policy which
is incorporated into these terms and conditions by this reference. Please
click Privacy Policy to view.

The Site places cookies onto your computer or device. By accepting
these terms and conditions, you are giving consent to Kiabi to place
cookies on your computer or device.  Please read the information contained
in the Privacy Policy prior to acceptance.

If you wish to opt-out of our placing non-necessary cookies onto
your computer or device, please either use the “manage preferences” option on
our site or adjust your Internet browser’s settings to restrict cookies as
detailed in your Internet browser’s help menu. You may also wish to delete

Kiabi makes no warranty or representation that the Site will

specific results from the use of our Service or Services.

Kiabi reserves the right to change the Site, its Content or
these Terms and Conditions at any time. You will be bound by any changes to the
Terms and Conditions from the first time you use the Site following the
changes. If Kiabi is required to make any changes to Terms and
Conditions by law, these changes will apply automatically to any orders
currently pending in addition to any orders placed by you in the future.

 

Availability of the Site

The Service is provided “as is” and on an “as available” basis. We
give no warranty that the Service will be free of defects and / or faults. To
the maximum extent permitted by law we provide no warranties (express or
implied) of fitness for a particular purpose, accuracy of information,
compatibility and satisfactory quality.

Kiabi accepts no liability for any disruption or
non-availability of the Site resulting from external causes including, but not
limited to, ISP equipment failure, host equipment failure, communications
network failure, power failure, natural events, acts of war or legal
restrictions and censorship.

 

Limitation of Liability

To the maximum extent permitted by law, Kiabi accepts no
liability for any direct or indirect loss or damage, foreseeable or otherwise,
including any indirect, consequential, special or exemplary damages arising
from the use of the Site or any information contained therein. Users should be
aware that they use the Site and its Content at their own risk.

Nothing in these Terms and Conditions excludes or
restricts Kiabi liability for death or personal injury resulting from
any negligence or fraud on the part of Kiabi .

Nothing in these Terms and Conditions excludes or
restricts Kiabi liability for any direct or indirect loss or damage
arising out of the incorrect provision of Services or out of reliance on
incorrect information included on the Site.

Whilst every effort has been made to ensure that these Terms and
Conditions adhere strictly with the relevant provisions of the Unfair Contract
Terms Act 1977, in the event that any of these terms are found to be unlawful,
invalid or otherwise unenforceable, that term is to be deemed severed from
these Terms and Conditions and shall not affect the validity and enforceability
of the remaining Terms and Conditions. This term shall apply only within
jurisdictions where a particular term is illegal.

 

No Waiver

In the event that any party to these Terms and Conditions fails to
exercise any right or remedy contained herein, this shall not be construed as a
waiver of that right or remedy.

 

Previous Terms and Conditions

In the event of any conflict between these Terms and Conditions
and any prior versions thereof, the provisions of these Terms and Conditions
shall prevail unless it is expressly stated otherwise.

Kiabi may from time to time send you information about our
products and/or services. If you do not wish to receive such information,
please click the “Unsubscribe” link in any email that you receive from us.

 

Law and Jurisdiction



The use of our website and the product purchase contracts through said website
shall be governed and construed in accordance with the applicable laws of Georgia. If you have an issue
with our Services, please contact us. We will endeavours to resolve your issue
as soon as possible.

 Any disputes or Claims arising out of or in connection with
these Conditions, including any non-contractual rights or obligations arising
out of or in connection with these Conditions shall be referred to and finally
resolved by Georgian
courts. Any controversy that arises or is related to the use of the website or
said contracts shall be subject to the non-exclusive jurisdiction of the Georgian courts.

How do I create an account ?

Creating a Kiabi account is a breeze! You can simply provide your details on our Register page and click Create my account now, and you're all set!

How do I change my password ?

To update your password, visit the Change Password page in the login page .

Can I change my email address ?

Unfortunately, we're unable to change your email address as it's linked to all your account details. If you wish to use a different email address, you'll need to create a new Kiabi account. Additionally, you have the option to delete your account.

How do I add a new payment card or remove an old one ?

During checkout, you'll have the opportunity to add a new payment card by saving its information. To remove an old card, sign in to your account, go to Account overview, and click on Saved cards.

Can I add a new shipping address or edit my existing address ?

Absolutely! Simply log in to your account, access your Account overview, and select Address book. From there, you can add or edit your shipping address and set a default address for future orders.

What else can I do with my Order history apart from viewing past orders ?

In addition to viewing past orders, your Order history provides information on current order statuses and access to digital receipts.

What else can I do with my account ?

Change your subscription preferences for newsletters and promotions by selecting My Preferences, and update your contact details in Account overview to receive tailored recommendations.

Can I shop without an account ?

Yes, you can. Simply choose to checkout as a guest. However, we'll still need a few details such as your contact number and address to process your order and ensure smooth delivery.

How do I know if I have completed my order ?

You'll know your order is complete when you reach our Thank you page with your confirmed order details. We'll also send you an email confirmation.

How can I check the status of my order ?

Track your order through the order confirmation email or shipping confirmation email, which includes a tracking link. You'll also receive an SMS with the tracking link once your order is out for delivery.

Can I cancel my order ?

Yes, as long as your order is still being processed. Contact us at KIABI ( 920006333 ) to cancel. If your order has already shipped, you can initiate a return within 14 days of receipt.

Why was my order cancelled ?

Orders may be cancelled due to stock availability or payment verification issues. We'll promptly refund any payments made.

Can in-store promotions and sales be applied to my online order?

Yes! Orders of SAR 250 or more qualify for free delivery.

When will I receive my order ?

Orders for Riyadh, Jeddah, Dammam are shipped the next day. For other areas, delivery takes 1-5 days.

How will I know when my order is on its way to me ?

We'll send you an email with a tracking link once your order has shipped. Additionally, our courier will contact you via SMS or WhatsApp to schedule delivery.

Can I change my shipping address after placing an order ?

Do I have to present anything at the time of shipping ?

You may be asked to present a valid ID, such as your Saudi Arabia ID, passport, or driving license.

Can someone else receive my order on my behalf ?

Absolutely! They just need to present their valid ID.

Returns & refunds

We understand that circumstances change. Here's how to proceed with returns and refunds.

How long do I have to return an item ?

You have 14 days from shipping or collection to return your purchase, provided it meets our return policy.

Returns can be processed through our return center or in-store with the original invoice.

Certain items, such as hygiene, earrings, jewelry, sunglasses, hair accessories, cosmetics, and underwear are not eligible for return.

Refunds will be issued according to the original payment method.

If you've paid Cash on Delivery, you'll receive a voucher code or cash refund in-store.

VAT and shipping fees are not refunded.

Once your return is confirmed, refunds will be processed accordingly.

Credit card payments will be refunded to the original card within 21 days.

Cash on Delivery payments can be refunded as a voucher code or in cash at a Kiabi store.
